Terms of Use

1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of Image Hotspots, the interactive image web part for SharePoint and Microsoft 365 developed by TryCatchDVLMNT ("TryCatchDVLMNT," "we," "us," or "our"). By installing, accessing, or using Image Hotspots, you agree to be bound by these Terms. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization, and "you" refers to both you and that organization. If you do not agree, do not install or use Image Hotspots. TryCatchDVLMNT is a DBA of Try Catch DVLMNT, based in Comal County, Texas.
2. License Grant (Lite / Free Use)
Image Hotspots Lite is made available free of charge. Subject to your compliance with these Terms, TryCatchDVLMNT grants you a limited, non-exclusive, non-transferable, revocable license to install and use Image Hotspots solely for your organization's internal business purposes. This is a license to use Image Hotspots, not a sale — you receive no ownership interest in Image Hotspots, the underlying software, or any copy of it. This license may be suspended or revoked by TryCatchDVLMNT at any time, with or without cause or notice.
3. Restrictions — No Reverse Engineering or Duplication
You may not, and may not permit or assist any third party to:
- copy, reproduce, distribute, sell, resell, lease, sublicense, or otherwise transfer the Image Hotspots SharePoint Framework (.sppkg) package, its associated TypeScript/JavaScript source or compiled code, or any portion of the application;
- decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code, algorithms, or underlying structure of Image Hotspots, except to the extent such restriction is expressly prohibited by applicable law;
- modify, adapt, translate, or create derivative works based on Image Hotspots, or remove, obscure, or alter any proprietary notices, branding, or attribution embedded in the application; or
- use Image Hotspots to build, train, or improve a competing product or service.
4. Intellectual Property
Image Hotspots, including all source code, object code, design, structure, organization, algorithms, user interface, documentation, and the TryCatchDVLMNT name, logo, and branding, is and remains the sole and exclusive property of TryCatchDVLMNT and its licensors. All rights not expressly granted to you in these Terms are reserved by TryCatchDVLMNT. No rights are granted to you by implication, estoppel, or otherwise. If you submit feedback, suggestions, or ideas about Image Hotspots, you grant TryCatchDVLMNT an unrestricted, royalty-free, perpetual license to use them without obligation to you.
5. Editions; Changes to Terms
Image Hotspots Lite is the free edition and is offered at TryCatchDVLMNT's discretion. TryCatchDVLMNT may offer additional paid editions, such as Image Hotspots Pro, with features not included in Lite; those editions may be subject to separate pricing and license terms. TryCatchDVLMNT reserves the right, at any time and upon notice (which may include an in-app notice, website posting, or email), to: (a) modify or discontinue any feature of Image Hotspots; (b) change which features are included in the Lite edition or move updates, support, or maintenance to a paid subscription or license model; and (c) revise these Terms. Continued use of Image Hotspots after such changes take effect constitutes acceptance of the revised Terms or pricing. If you do not agree to a change, your remedy is to stop using Image Hotspots.
6. Your Data & Your SharePoint Tenant
Image Hotspots operates within your organization's own Microsoft 365 and SharePoint tenant, and the images, hotspot configuration, and related content you create is stored in that tenant — not on TryCatchDVLMNT servers. You are solely responsible for the content you host, your organization's configuration, security, backups, access permissions, and compliance obligations within your own tenant. TryCatchDVLMNT has no access to, control over, or responsibility for data stored in your tenant except as described in the Image Hotspots Privacy Policy. TryCatchDVLMNT is not responsible for the availability, security, or performance of Microsoft 365, SharePoint, or any other third-party platform Image Hotspots relies on.
7. Disclaimer of Warranties
IMAGE HOTSPOTS IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. TRYCATCHDVLMNT DOES NOT WARRANT THAT IMAGE HOTSPOTS WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA LOSS WILL NOT OCCUR. AS A FREE PRODUCT, IMAGE HOTSPOTS LITE MAY CONTAIN BUGS, ERRORS, OR OTHER ISSUES.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRYCATCHDVLMNT AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE IMAGE HOTSPOTS, INCLUDING ANY DATA HOSTED WITHIN YOUR OWN MICROSOFT 365 OR SHAREPOINT TENANT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TRYCATCHDVLMNT'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO IMAGE HOTSPOTS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100), OR (B) THE AMOUNT YOU PAID TRYCATCHDVLMNT FOR IMAGE HOTSPOTS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless TryCatchDVLMNT from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of Image Hotspots, your violation of these Terms, or your violation of any third-party right, including rights related to data you store or process within your own tenant.
10. Termination
TryCatchDVLMNT may suspend or terminate your access to Image Hotspots at any time, with or without notice or cause, including for suspected violation of these Terms. You may stop using Image Hotspots and uninstall it at any time. Upon termination, the license granted in Section 2 immediately ends, and Sections 3, 4, 6, 7, 8, 9, 11, and 12 survive termination.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
Binding arbitration; class action waiver. Any dispute, claim, or controversy arising out of or relating to these Terms or Image Hotspots will be resolved exclusively by final and binding arbitration, rather than in court, except that either party may bring an individual action in small claims court. The arbitration will be administered by a mutually agreed arbitration provider under its applicable rules then in effect, and will be seated in Comal County, Texas. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. You and TryCatchDVLMNT each waive any right to a jury trial and to participate in a class, collective, or representative action. Any claim not subject to arbitration, or any action to compel arbitration or enforce an arbitration award, will be brought exclusively in the state or federal courts located in Comal County, Texas, and you consent to personal jurisdiction there.
12. General
- Entire agreement. These Terms, together with the Image Hotspots Privacy Policy, constitute the entire agreement between you and TryCatchDVLMNT regarding Image Hotspots.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
- No waiver. TryCatchDVLMNT's failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign or transfer these Terms without TryCatchDVLMNT's prior written consent; TryCatchDVLMNT may assign these Terms freely.
- No third-party beneficiaries. Microsoft is not a party to these Terms and has no obligations to you regarding Image Hotspots.
